An arrest in the UAE moves quickly, and every hour a person spends in custody can affect their job, their family, and their case. Our lawyers at GS Advocates & Legal Consultants help clients apply for bail, negotiate with the Public Prosecution, and secure a provisional release while the investigation or trial continues. Whether the matter involves a misdemeanor, a felony, or a case tied to a travel ban, our legal team moves fast to protect a client's liberty and reputation.
Bail in the UAE is governed primarily by Federal Decree-Law No. 38 of 2022 Concerning the Criminal Procedure Law, which took effect on 1 March 2023 and replaced the earlier 1992 procedural code. Under Article 108, an accused person may be granted bail by the Public Prosecution, either on its own initiative or following a formal request from the accused or their lawyer.
Authority over bail shifts as a case progresses. Before a file reaches the Public Prosecution, the police may grant a provisional release. Once the Public Prosecution takes over, it decides on bail until the matter is referred to court, after which the presiding judge holds that authority. Because the decision-maker changes at each stage, a bail application prepared without local procedural knowledge can lose valuable time.
Not every accused person qualifies. Article 111 excludes bail for crimes carrying the death penalty or life imprisonment, and prosecutors weigh the strength of the evidence, flight risk, and the nature of the charge before granting a release. Separately, a travel ban may be imposed under Article 99 even where bail is granted, so our lawyers routinely address both issues together rather than treating them as separate problems.
Our legal team supports clients through every stage of a bail matter, including:
Because bail is rarely the end of a case, our lawyers also prepare the wider defense strategy from day one, so the client’s position is consistent from the first hearing through to a final verdict.
Clients typically move through a structured process once they engage our firm:
This structure means a client is never left guessing what comes next, and our lawyers stay involved from the first police enquiry through to the final resolution of the case.
You, a family member, or your lawyer can submit a bail request to the police, the Public Prosecution, or the court, depending on the stage of your case. Our lawyers prepare the application, gather the required documents, and submit the request as quickly as possible.
Yes. Foreign nationals can apply for bail just like UAE citizens. However, the authorities may review residency status and flight risk before making a decision. In some cases, they may ask for a local guarantor or financial security.
The timeline depends on the case. Simple misdemeanor cases may receive a decision within a few days, while more complex criminal cases often take longer. Our lawyers actively follow up with the Public Prosecution to help move the process forward.
Once the authorities approve bail, they release the accused under specific conditions. These conditions may include paying a financial guarantee, reporting to the authorities, or following travel restrictions. Our lawyers explain every condition clearly and help clients comply with all legal requirements.
You usually need the accused’s passport or Emirates ID, the case reference number, and the guarantor’s details. Our lawyers review your case and confirm the exact documents required before submitting the bail application.
